Privacy Policy

SMS disclosure: Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
Commission Scaling LLC ("Commission Scaling," "we," "us," or "our") operates www.commissionscaling.com (the "Site"). This Privacy Policy explains what personal information we collect, how we use it, who we share it with, and the rights you have over it.
1. Information we collect
Information you give us
- Contact details — name, email address, mobile phone number, mailing address.
- Professional details — insurance licensing states, agency name, team size, current lead sources, and similar business information you provide.
- Consent records — the date, time, IP address, page URL, and the exact consent language displayed when you submitted a form or opted in to messaging.
- Communications — the content of emails, text messages, form submissions, and recorded or transcribed calls where you have been notified and, where required by your state, have consented.
- Payment information — processed by our third-party payment processor. We do not store full card numbers on our systems.
Information collected automatically
- IP address, browser type, device type, operating system, referring URL, pages viewed, and time spent.
- Cookies and similar technologies, including advertising and analytics pixels (see Section 6).
2. How we use your information
- To respond to your inquiry and schedule, confirm, and remind you of appointments.
- To provide the services you have purchased, including lead delivery, CRM access, automation, and reporting.
- To send you marketing communications by email or SMS where you have opted in, and to stop sending them when you opt out.
- To measure and improve advertising performance and site experience.
- To maintain records of consent, to screen against do-not-call and internal suppression lists, and to comply with the Telephone Consumer Protection Act (TCPA), CAN-SPAM, and applicable state law.
- To detect fraud, enforce our Terms, and comply with legal obligations.
3. Text messaging (SMS/MMS)
If you opt in to text messages from Commission Scaling LLC, you may receive appointment reminders, appointment confirmations, follow-up regarding your inquiry, service notifications, and promotional offers. Messages may be sent using automated technology, including AI-assisted conversational messaging.
- Consent is never a condition of purchase and the consent checkbox on our forms is never pre-checked or required.
- Message frequency varies. Message and data rates may apply.
- Reply STOP to any message to unsubscribe. You will receive one confirmation message and no further messages from that program.
- Reply HELP for assistance, or contact us at info@commissionscaling.com.
- Carriers are not liable for delayed or undelivered messages.
Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. Information may be shared with subcontractors in support services, such as customer service and messaging platforms, solely to deliver the messages you have requested. Text messaging originator opt-in data and consent is excluded from any and all sharing.
4. How we share information
We do not sell your personal information. We share it only as follows:
- Service providers — CRM, messaging, email, hosting, calendar, analytics, and payment vendors, bound by contract to process data only on our instructions.
- Advertising platforms — hashed identifiers may be shared with platforms such as Meta for conversion measurement and audience matching. Mobile opt-in data and consent records are excluded.
- Legal — where required by law, subpoena, or to protect our rights or the safety of others.
- Business transfer — in connection with a merger, acquisition, or sale of assets, subject to this Policy.
If you are a client of Commission Scaling, the consumer lead data we deliver to you is transferred to you as an independent controller. Your handling of that data is governed by our Terms of Service and by your own legal obligations.
5. Data retention
We retain consent records for a minimum of five years after the last contact, which is longer than the TCPA statute of limitations, because a documented consent record is the evidence that protects both you and us. Other personal information is retained for as long as needed for the purposes described above and then deleted or de-identified.
6. Cookies and tracking
We use strictly necessary cookies to operate the Site, analytics cookies to understand usage, and advertising cookies and pixels (including the Meta pixel and Google tags) to measure campaign performance. You can control cookies through your browser settings. Where required by law, we present a cookie banner allowing you to accept or reject non-essential cookies before they are set.
We honor Global Privacy Control (GPC) browser signals as a valid opt-out of the sharing of personal information for cross-context behavioral advertising.
7. Your rights
California residents (CCPA/CPRA)
You have the right to know what personal information we collect, to access and receive a copy of it, to request deletion, to request correction, to opt out of sale or sharing for cross-context behavioral advertising, to limit use of sensitive personal information, and not to be discriminated against for exercising these rights. We do not sell personal information. To exercise a right, email info@commissionscaling.com. We will verify your identity before responding and will respond within 45 days.
Other U.S. state privacy laws
Residents of states with comprehensive privacy laws (including Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, and others as they take effect) have comparable rights of access, correction, deletion, portability, opt-out of targeted advertising, and appeal of a denied request. Use the same contact address above.
EEA/UK residents
Where GDPR or UK GDPR applies, our lawful bases are consent (marketing), contract (service delivery), and legitimate interests (security, fraud prevention, service improvement). You may access, correct, erase, restrict, or port your data, object to processing, and lodge a complaint with your supervisory authority.
8. Do Not Call
We screen against the National Do Not Call Registry and maintain an internal do-not-call list. To be added to our internal list, email info@commissionscaling.com or reply STOP to any text. Requests are honored within 10 business days and are retained indefinitely.
9. Security
We use encryption in transit, access controls, and vendor due diligence to protect personal information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
10. Children
The Site is not directed to anyone under 18 and we do not knowingly collect personal information from minors. If you believe a minor has provided us information, contact us and we will delete it.
11. Changes
We may update this Policy. Material changes will be posted here with a revised "Last updated" date, and where required we will notify you directly.
